This Short Term Vacation Rental Agreement (the “Agreement”) is made by and between Kold Holdings LLC (“Owner”) and _____________________________ (“Guest”). Your signature on this Agreement, or payment of money or taking possession of the property after receipt of this Agreement is acceptance of this Agreement and your intent to use the property for a vacation rental.

The rental policies apply to all guests; failure to comply can result in eviction. Eviction for failure to comply with our policies will result in forfeiture of all rental payments and deposits. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

Reservations

Red Fox Hollow rents to tenants who must be 24 years of age or older.

Reservations are guaranteed once the signed rental agreement and payment of 100% of the total rental charges have been received by the Owner.

There is a two-night minimum reservation for all stays.

Cancellation & Refund Policy

We understand that sometimes it is necessary to change or cancel a reservation. All cancellations or reservation changes must be made in writing to info@redfoxhollow.com.

No refunds for early departures, delayed arrivals, no-shows. No refund will be given for failure to use property due to inclement weather. If Guest(s) are evicted for unruly behavior by Owner or the local law enforcement no refunds will be issued.

Owner reserves the right to cancel the reservation at any time, with or without notice, to address unforeseen emergent circumstances related to repairs of the property or other emergencies. Owner will not be responsible for the costs of relocation; however, Owner will issue a full refund of any security deposit or prepaid rental fees should the need to cancel or relocate arise.

Cleaning Fee

There is a flat one-time $50 cleaning fee. If there is a need for any excessive cleaning after your departure, the credit card on file will be charged a minimum of $150 depending on the nature of the damage or mess.

Security Deposit

Guest agrees that a security deposit of $250 will be preauthorized on Guest’s credit card one (1) day prior to the reservation and will be held for up to five (5) days after check out. If there is no damage to the property, the full amount will be refunded. If damage occurs during your stay, the security deposit will be used to cover any damage. Guest is responsible for all damage exceeding the security deposit.

Maximum Guest Limit

Red Fox Hollow is limited to seven (7) people. No more than seven guests shall be permitted anywhere on the premises at any time. If occupancy exceeds that represented on the reservation at any time immediate eviction will occur without refund.

Pets

Pets are not permitted on the premises at any time. Renters found with a pet on the premises will be asked to remove the pet immediately. Failure to do so will result in immediate eviction. In the event of an eviction, no refund will be issued. Any violation of this policy will result in a $500 pet cleaning fee that will be assessed and charged to your credit card to clean all carpets within the cabin, and any additional cleaning necessary and all damages incurred by said animal(s) will also be charged to your credit card.

Smoking

Red Fox Hollow is a smoke-free property. No smoking is permitted in the cabin or anywhere on the premises. This prohibition includes E-cigarettes.

If we find that there has been smoking inside the cabin a cleaning fee of $500 will be charged to the credit card on file.

Check-In

• Check in time is 4 PM.
• Check out time is 10 AM.
• Before check in, a code will be e-mailed to you so that you can access the rental.
• UPON ARRIVAL you must notify me of any missing or inoperative furnishings or equipment or of any unsafe conditions that may result in injury. Every effort will be made to repair the equipment/condition as soon as possible after being notified. No refund or adjustment in rate will be made for mechanical failures.
• There is plenty of parking at Red Fox Hollow for all guests in your party.

Check-Out

• Check out is 10 AM. Should check-out time be extended (without prior approval) you will be charged an additional night’s stay.
• No damage should be done to the cabin or its contents, or the premises beyond normal wear and tear.
• All trash must be placed in the trash bins located in the cabin.
• No linens should be lost or damaged.
• Dishes, pots, pans, silverware, and utensils must be washed, dried, and put away and the stove/oven shall be left in a clean condition.
• The refrigerator should be left clean and free of food.
• Towels should be placed in the bin for dirty towels located in the laundry room.
• Windows and doors must be closed and locked with the air conditioner on 75 degrees or heat on 60 degrees depending on the season.
• The cabin will have a cleaning service upon your departure, but it is expected that the cabin will be left relatively neat and clean.
• Please notify me immediately upon any damage or breakages that might have occurred during your stay. Guest(s) are responsible for any damage, abuse, excessive cleanup requirements, or loss caused by any member of Guest(s) party to the property or its contents during Guest(s) occupancy. A walk through of the cabin is made within 5 days after each checkout to ensure that the property is left in good order. At which time, a determination will be made of the necessity of any charges to Guest(s).

Indemnification and Hold Harmless; Right of Entry; Assignment

Guest(s) agrees to indemnify and hold harmless the owner and the owner’s agents, subcontractors and/or employees from and against any liability for personal injury, accidents, illnesses (including allergies), property damage sustained by any person; including, but not limited to, guest and invitees of the Guest(s), as a result of any cause, unless caused by the intentional or reckless act of Owner. Additionally, Owner is not responsible for the loss of personal belongings or valuables of Guest(s). By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.

Guest(s) agree(s) that Owner or their respective representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations, or improvements hereto as Owner deems appropriate.

Property

Red Fox Hollow has a creek running through the Property, a fire pit, a grill, a pellet stove, and a hot tub (collectively, “High Risk Amenities”). There are inherent risks and dangers associated with the use of all of the High Risk Amenities. You are free to use and enjoy all of the High Risk Amenities, but all Guest(s) do so at their own risk and agree to release Owner and hold Owner harmless from any and all liability associated with said use.

Children

Children are the responsibility of the parents and must be supervised at all times, especially due to the location of the creek on the Property. Parents should be within an arms length of all children when near the stream. It is very important that children be supervised at all times, no running on decks, no climbing on railings, no climbing in trees, no climbing on the roof, no horseplay, no throwing rocks, no using the hot tub, no using the pellet stove, no using the grill, no running near the fire pit, and please make sure they remain a safe distance from any fires, this is not an all-inclusive list but only general in nature of items that should not be allowed under any circumstances. Please watch your children.

WiFi
There is wireless internet in the cabin, but service is not guaranteed. The WIFI name is vsat-5g-8834A4 and the PASSWORD is .

TV

There are two TV’s located within the cabin. However, there is not cable and the TVs run off of the satellite internet so streaming may be interrupted at times due to buffering. Additionally, there is a selection of DVD movies for you to enjoy during your stay.

Phone

There is no landline phone. Cell phone service can be spotty in the area. Cell phones typically work outside the cabin.

Shoes

Cleanliness is our priority so please remove your shoes upon entering the cabin.

Security Cameras

There are security cameras located outside on the property. These cameras do not enhance your safety, but are there to enable us to monitor the Property when it is vacant. There are not security cameras inside the cabin, but there are motion detectors.

Septic System

Red Fox Hollow utilizes a septic system. Please do not dispose of feminine products, wipes, napkins, paper towels, tissues, diapers, Q-tips, cotton balls, or hair in the sink or toilet.

Utility Closet

The walk-in closet in the master bedroom has been converted to a utility closet due to the location of the electrical panel inside. Please do not hang clothes in the closet. A dresser has been provided in the master bedroom for your convenience to store your clothes. In addition, there is hanging space located in the closet under the stairs off of the kitchen.

Loft

The stairs going up to the loft area are steep. Please use the handrail and use caution when going up and down, and please supervise children. The loft is intended for a sleeping area and is most suitable for children due to the low ceiling height; however, adults are free to use this area for sleeping as well just use caution due to the low ceiling.

Repairs and Service Calls

Owner performs regular maintenance of Red Fox Hollow, however, if there is an issue please call (702) 755-5678. Owner will make every effort to have repairs done quickly and efficiently.

Loss or Damage

Owner is not liable for any loss or damage to any valuables or property belonging to Guest(s) or their visitors.

Prohibited Activities

No four wheelers or other off road vehicles of any kind, no tent camping, no motorhomes, no guns, no fishing, no loud music, no fireworks, no unattended children.

Fire Safety

Only have fires in the fire-pit area and keep small enough to fit within the diameter of the fire ring or fire pit. Do not leave fires unattended and always throw water on fire when finished. Do not drag uncut logs or trees onto a fire. Do not leave burning grill unattended or pellet stove unattended. Do not discard burning embers, charcoal, or ashes on the ground. Dump into fire-pit or pellet stove or wait until cool and bury. There are two fire extinguishers located in the cabin, one underneath the kitchen sink and one underneath the bathroom sink.

Grill

Please clean off the grill after each use, and please do not use the grill on the deck.

Sleeping Accommodations

Red Fox Hollow sleeps 7 people.

There is one bedroom with a queen bed.

There is a loft that has two twin beds, and a pull out twin trundle.

The family room has a pull out queen sofa bed.

Accommodations and Amenities

Red Fox Hollow is equipped with a washer and dryer, refrigerator, TV and DVD player, blow dryer, Keurig, toaster, crock pot, blender, air fryer, microwave, stove top and oven, pots and pans, dishes, flatware, basic cooking utensils, drinking glasses, pellet stove, hot tub, outdoor grill, outdoor grill tools, swing, outdoor patio and chairs, and outdoor fire pit.

In addition to what is noted above, we also provide:

Bed linens and towels for each guest

Soap and shampoo

Trash bags for kitchen trash can and mini trash cans located throughout the cabin

Paper towels, napkins and toilet paper

Beach towels for hot tub

Dish detergent

Universal charger

Variety of books and games

While we do everything to ensure comfort and convenience, daily maid service or cleaning service is not provided.
